SERVICES AND CONDITIONS OF USE

Welcome to the NIMBAS ALUMNI NETWORK. This new online Service for alumni is provided subject to this Terms of Service Agreement ("Terms"). Your use of the Service indicates that you accept these terms. NIMBAS ALUMNI NETWORK may modify these Terms at any time and may discontinue any or all of the on-line services. Your continued use of the Service, after online notice of modifications, signifies your agreement to be bound by the modifications. You agree to use the Service in accordance with these Terms, as modified from time to time. If you do not agree to be bound by these Terms, please exit the NIMBAS ALUMNI NETWORK. Please note that you will be referred to as "you" or "User" from time to time in these Terms.

NIMBAS ALUMNI NETWORK is a private organisation, organised by current/former NIMBAS students for NIMBAS Alumni.

ELIGIBILITY TO USE THE SERVICE

At this time, only NIMBAS Alumni and NIMBAS ALUMNI NETWORK Representatives will have access to the Service. By using this Service, you represent that you are a NIMBAS alumnus/a.

RULES FOR ONLINE CONDUCT

You agree to use the Service in accordance with all applicable laws. You agree that you will not post any of the following content anywhere on the Service, or on any other NIMBAS ALUMNI NETWORK computing resources:

- Material that defames or threatens others

- Statements that are bigoted, hateful or racially offensive

- Material that discusses illegal activities with the intent to commit them

- Material that contains vulgar or obscene language or images

- Advertising or any form of commercial solicitation

You are strictly prohibited from using the broadcast email feature for commercial purposes. Furthermore, the Lifetime email system and its features, such as Mailing List, may not be used to share and/or sell Mailing Lists generated on the NIMBAS ALUMNI NETWORK.

By accepting these terms and conditions, you agree to respect fellow users and not abuse the privilege of having access to the site. If complaints about your abuse of the system are received, you will receive a written and /or verbal warning. If the behaviour continues, your account privileges will be suspended and possibly terminated.

Although NIMBAS ALUMNI NETWORK does not routinely screen or monitor content posted by users, NIMBAS ALUMNI NETWORK reserves the right to remove content which violates the above rules of which it becomes aware, but is under no obligation to do so.

Finally, you agree that you will not access or attempt to access any other user's account, or misrepresent or attempt to misrepresent your identity while using the Service.

DISCLAIMER RE: CONTENT AND ONLINE COMMUNICATION FORUMS

Several communication forums may be provided through this Service, such as mailing lists, bulletin boards, newsgroups, discussion groups and other communication services that may be offered from time to time ("Forums"). These Forums are offered to foster communication among alumni Users. Forums are mostly unmoderated and contain the personal opinions and other expressions of the Users who post to them. Forums are not routinely screened, approved, reviewed or endorsed by NIMBAS ALUMNI NETWORK. NIMBAS ALUMNI NETWORK is not a publisher of any of the content of the Forums, or of any content that may be available through links to and from them (other than links to NIMBAS ALUMNI NETWORK pages). By using the NIMBAS ALUMNI NETWORK alumni directory on-line, the User acknowledges that NIMBAS ALUMNI NETWORK only role is to provide the service. If you feel you might be offended by the content of the Forums, you should not access them. In addition, you agree that the Service may include the views, opinions and recommendations of individuals or organizations that may be deemed of interest, but that NIMBAS ALUMNI NETWORK does not review or endorse these views, opinions or recommendations.

LINKS TO OTHER SITES

NIMBAS ALUMNI NETWORK may include hyperlinks to websites maintained or controlled by others. NIMBAS ALUMNI NETWORK is not responsible for and does not routinely screen, approve, review or endorse the contents of or use of any of the products or services that may be offered at these websites.

LIMITATION OF LIABILITY AND WARRANTY

The service is provided "as is." Use of the service, and any information obtained from the service or links to it, is entirely at User's risk. NIMBAS ALUMNI NETWORK does not warrant, and hereby disclaims any warranties, either express or implied, including but not limited to warranties of accuracy, completeness, noninfringement, merchantability or fitness for a particular purpose of any information, products or services obtained from the service or a link to it. NIMBAS ALUMNI NETWORK does not warrant that the service will operated in an uninterrupted or error-free manner or that the service is free of viruses or other harmful components.

You agree that neither NIMBAS ALUMNI NETWORK, nor its agents, affiliates, licensees, or third party content or service providers, will be liable to you for any loss or damages, either actual or consequential, including personal injury or death, arising out of or relating to these terms, your (or any third party's) use or inability to use the service, or to your placement of content on the service, or to your reliance upon information obtained from or through the service. In particular, neither NIMBAS ALUMNI NETWORK, nor its agents, affiliates, licensees or third party content or service providers, will have liability for any consequential, indirect, punitive, special or incidental damages, whether foreseeable or unforeseeable (including, but not limited to claims for defamation, errors, loss of data, or interruption in availability of data), arising out of or relating to these terms, your use or inability to use the service, or to your placement of content on the service, or to your reliance upon information obtained from or through the service, whether based in contract, tort, statutory or other law.

NOTICE

NIMBAS ALUMNI NETWORK may give notice regarding the Service and any changes to it to Users by means of a general notice posted online, electronic mail to User's e-mail address of record, or by written communication sent by first class mail to a User's address on record in NIMBAS ALUMNI NETWORK platform. You may give notice to NIMBAS ALUMNI NETWORK (such notice shall be deemed given when received by NIMBAS ALUMNI NETWORK at any time by any of the following method):

INDEMNIFICATION

You agree to indemnify and hold NIMBAS ALUMNI NETWORK harmless from any claims, losses or damages, including legal fees, resulting from your violation of these Terms, or your use of the Service, including your placement of any content on the Service, and to fully cooperate in the defense by NIMBAS ALUMNI NETWORK against any such claims.

TERMINATION OF SERVICE

You may terminate your account by emailing admin@nimbasalumni.com. NIMBAS ALUMNI NETWORK may terminate your account, your access rights to the NIMBAS ALUMNI NETWORK Alumni plattform, or the entire service, or any portion thereof, at any time, with or without notice and at its sole discretion.
